Terms and Conditions for India Magica Tours:

Reservation:
All reservations must be submitted in writing via email or fax to India Magica Tours. Reservations will be considered confirmed upon receipt of payment and the completion of the necessary information form provided by our team. Detailed booking procedures and requirements will be communicated upon reservation confirmation.

Passport and Visa:
Foreign nationals traveling to India must possess a valid international travel document, typically in the form of a national passport, along with a valid visa obtained from an Indian mission or consulate abroad. Passport validity must extend at least six months beyond the intended date of departure from India. India Magica Tours advises clients to ensure compliance with all relevant visa and passport regulations. Any fines, sanctions, or expenses incurred due to non-compliance with these requirements shall be the responsibility of the traveler.

Insurance:
While traveling with India Magica Tours, it is strongly recommended that travelers obtain comprehensive personal travel insurance to cover any unforeseen circumstances or emergencies during their trip. India Magica Tours does not provide travel insurance coverage.

Payment:
Upon confirmation of services, an invoice will be generated detailing the total cost of the tour package. Payment can be made via wire transfer to our designated bank account in India. For contracted services, a minimum deposit of 25% of the total tour cost is required to secure the reservation. Full payment is due 30 days prior to the commencement of services. Late bookings made within 30 working days of the service start date require full payment at the time of booking.

Note: For luxury train travel, hotel or resort bookings during peak seasons or festivals, full payment is required at the time of booking. Full payment from certain countries (Nepal, Bhutan, Sri Lanka) and for domestic or international flight tickets is also required in advance.

Payment Methods:
International customers can choose to make payments using the online gateway payment system or through bank transfer. All payments must be made free from any withholding tax and deductions. Any bank charges incurred during the remittance process shall be borne by the payer.

Cancellation, No Show, Early Departure Policy:
In the event of tour or travel service cancellations, clients must inform India Magica Tours in writing. Cancellation charges will apply based on the time of notification, with varying refund percentages depending on the proximity to the departure date. A minimum service charge applies to all cancellations. Refunds for unused services will be processed according to the cancellation policy and may take several weeks due to banking procedures.
For cancellations made more than 30 days prior to the departure date, a refund of 50% of the deposit will be issued after deducting applicable charges, including bank fees (€20), booking fees (€45), flight cancellation fees (€20 per person, with 100% of the cost deducted), and the current fare for train tickets.
Cancellations made less than 30 days before the departure date will incur a 100% cancellation fee, with Ciao India Tours retaining the full cost of the trip.

Arrival and Departure Policy:
Standard check-in and check-out times at hotels range from 1200 to 1500 hours and 1000 to 1200 hours, respectively. Early check-in and late check-out requests are subject to availability and may incur additional charges. Extra use of vehicles beyond the specified itinerary is not included in the tour package and must be arranged separately. Travel times between cities are approximate and subject to traffic conditions.

Responsibilities and Limitations:
India Magica Tours acts as an agent for various service providers including hotels, airlines, transporters, and other contractors. While every effort is made to ensure the smooth operation of services, India Magica Tours is not liable for any delays, changes, or expenses incurred due to circumstances beyond its control. Itineraries provided are sample routes and may be subject to change based on external factors. Clients are responsible for additional expenses resulting from unforeseen circumstances.

Dispute Resolution and Jurisdiction:
Any disputes arising from the contract between India Magica Tours and the client will be referred to an arbitrator appointed by India Magica Tours. All disputes are subject to the exclusive jurisdiction of the courts of India, and Indian law governs the interpretation and enforcement of these terms and conditions.

Important Information:
India Magica Tours adheres to all relevant government regulations, including smoking policies in hotels and public places. Clients with specific requests, such as smoking rooms, should inform India Magica Tours in advance, and every effort will be made to accommodate their preferences based on availability.

Additional Terms:
India Magica Tours reserves the right to refuse service to any individual deemed undesirable at our discretion, without the need for justification. Clients are required to comply with all local laws, regulations, and customs during their travels.

Refund Policy:
Refunds for unused or cancelled services will be processed in accordance with the cancellation policy outlined above. The refund amount will be credited to the original payment method and may take 2-4 weeks to be processed due to banking procedures. Bank charges incurred during the refund process will be deducted from the refund amount.

Changes to Itinerary:
India Magica Tours reserves the right to modify any aspect of the itinerary, including transportation and accommodation, without prior notice, to ensure the safety, comfort, and well-being of our clients. Any additional costs incurred due to such changes will be the responsibility of the client.

Force Majeure:
India Magica Tours shall not be held liable for any delays, cancellations, or additional expenses incurred as a result of force majeure events beyond our control, including but not limited to natural disasters, political unrest, acts of terrorism, or government regulations.

Contractual Agreement:
By booking a tour with India Magica Tours, clients agree to abide by these terms and conditions, as well as any additional policies or regulations communicated by our team. These terms constitute the entire agreement between the client and India Magica Tours and supersede any prior agreements or understandings.

Complaints:
Any complaints or concerns regarding the tour services provided by India Magica Tours should be brought to our attention immediately, allowing us the opportunity to address and resolve the issue promptly.

Privacy Policy:
India Magica Tours respects the privacy of our clients and is committed to protecting their personal information. Any data collected during the booking process will be used solely for the purpose of facilitating the tour arrangements and will not be shared with third parties without consent, except as required by law.

Accessibility:
India Magica Tours strives to accommodate travelers of all abilities and will make reasonable efforts to accommodate special requests or accessibility requirements. Clients with specific needs should inform our team at the time of booking to ensure appropriate arrangements are made.

Intellectual Property:
All content, including but not limited to text, images, and logos, displayed on the India Magica Tours website and promotional materials are the intellectual property of India Magica Tours and may not be reproduced or used without permission.

Updates to Terms and Conditions:
India Magica Tours reserves the right to update or modify these terms and conditions at any time without prior notice. Clients are encouraged to review the terms periodically for any changes or updates.
